Please be considerate to your good employer and good attorney of yours. You do not want to burn bridges, when you leave. Give them at least 2-3 weeks notice. That is the least or at least work with them for 6 months since that is what the law would require you after getting GC.

Even I was interested in similar scenario.
1. What happens when changing employers when I-140 and I-485 pending for less than 180 days?
2. From my understanding, the process needs to restart. However, do I have to do something to withdraw pending I-485.
3. Will it be termed as denied I-485 and create problems if I apply new I-485 with new employer?

I got laid off with a pending I-140 filed July 2006 along with I-485. I was told that as soon as those docs are filed my H1B becomes invalid. True? I still have an approved H1B receipt from another company valid thru Feb 2008. Can I still use it? Thank you.

Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.
When an eb2 complains about not having ead his concerns are valid and nothing else is more important on IV thean that

Given thanksgiving is barely a week away, we can be certain of the usual platitudes directed at immigrants - this is a good time to remind the average American how far they have strayed from their roots and forgotten the true sentiment behind the tradition. Immigrants have always been hated and reviled by those that got here earlier - but the current anti-immigrant sentiment is vastly different in scale and sophistry due to the times we live in. If every IV member signs up 10 citizens to the immigrant cause, we should easily be 100,000 strong in a couple of weeks. It could be anyone from your advisor at school who mentored you to your buddies at work - even the stinkin relatives should be harassed. Though CIS and Numbersusa pretend that they are a product of the current anti-illegal sentiment, they started out much before the so-called 'wave' started. And they have adapted and honed their strategies very well to crush whatever relief Congress contemplates/passes. Consider the way CIS was initially dedicated to 'researching' immigrant issues that they would complain about the media's positive stories about immigrant contributions as merely anecdotal evidence not worthy of rebuttal. Now they are suddenly fond of anecdotal evidence themselves since experts began demolishing their claims of job-stealing and other baseless charges convincingly(esp CFR's Sebastian Mallaby) using empirical evidence-they shamelessly stoop to use someone's sob story to make their case. So, as repugnant as their motives are, they are too transparent for their own good- and they can't cover their tracks -which is good for us since we are appealing to the fair minded. Remember - every one in the US is an immigrant or an offspring of one. They have always been hated and reviled -so if someone who benefited from the immigrant tradition of this nation wants to turn around and deny it to those following him/her even though their ancestors did the same thing at a great emotional/economic cost to the then existing natives- they have a higher bar in explaining why the current bunch shouldn't continue to benefit from the great tradition-merely being bigoted but sophisticated enough to hide it isn't enough. so don't lose heart but dont sit on your ass either.

1. Is there an urgent processing option for the AP? And how ?

Thanks, Andy. So, 80K LCs a year, 10%-15% of them will probably never get to AOS stage, 20% of those were duplicates (for people with petitions stuck in the backlog centers), so we are talking about 50-55K new labor certificates each year that will result in I-485. This is very consistent with 85K new capped H1Bs plus whatever number of exempt (non-profit research) H1Bs every year. So, we are talking about 100-110K total AOS applications (with dependents). Now lets take 140,000 EBs, substract Schedule A and EB1 (no need for LC), and there is probably 10K extra EB visas should be left over each year (quota less new potential EB petitions). Those are probably going to land in EB3 ROW. That means the retrogression will become less severe. What we are experiencing right now, is the rabbit that moves through the snake - the EB petitions resulting from a higher H1 cap several years ago.
Let us not also forget that current estimates are that there are 1.1 million applications pending at all stages of the green card process. Notwithstanding the new additions each year.

Guess what I called again and this time the poor soul knew NOTHING about I-485 rejections!! :p He put me on hold and finally said, "We have received no such notice that they are rejecting I-485s, so if you applied it should be processed".
So much for "educated" call center workers. If this call center was in India, atleast we would all get ONE answer. It may have been the wrong answer, but atleast it would be CONSISTENT :P

Based on the labor approvals, I am expecting EB2 will touch 2007 in the next 3 to 5 visa bulletins. Since, till late 2005 EB2 is current only. Say there are about 10 thousand back log EB2s and they need 10thousand *2.5 visas= 25 thousand visas.Because in 2006, 22298 labors been approved, say half of that means 10 thousand are EB2 and 10 thousand *2.5= 25,000 visas are neaded to clear offf all 2006. So to clear all EB2s till 2006 Dec theres a need of 50k visas. But due to the spillovers we are getting 50k visas in 2008 fiscal year itself. So for the year starting with 2009 theres a strong possibility of EB2 PD to move to 2007. And before and after PERM there are very few applied for Labors. The above data itself showing the less numbers after PERM implemented.

I receive the standard IRS letter regarding stimulus rebate.
I took this letter and went to SSA office to apply for a SSN for my wife.
Point number 3 in ss-5 clearly says .....
"If you check "Legal Alien Not Allowed to Work," you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S. State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your reason qualifies.
If you check "Other," you must provide a document from the U.S. government agency that explains why you need a Social Security number and that you meet all of the requirements for a Federal benefit except for the number."
I believe that IRS letter should be treated as a sufficient reason for need of SSN. BUT THEY DIDN'T ENTERTAIN ANY OF THE FACTS AND DECLINED TO ACCEPT APPLICATION FOR SSN.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. At least that is my motivation.
In my case, the first time I called, the person hung up on me. But I did not give up. I got them to accept the application and it is currently under reconsideration. I was also able to get a response from the Regional Office. So far they have not addressed any of the points I made in the original case as described in the OP. I expect they will continue to ignore their own laws and regulations, until I appeal this to an administrative judge, who will make a legal ruling.

Did anyone research whether it is possible to get some relief through rulemaking, instead of legislation? For example, there is no 'explicit' prohibition against issuing employment authorization to spouses of H1bi employees. The rule-making agency (in this case the DHS or USCIS) can grant a benefit that spouses be provided with employment authorization. Recently, the USCIS actually did provide regulatory relief by de-coupling the H1bi period of stay from the period of stay in H4 status. An idea to consider...

current immigration law is very subjective and many organizations or interpretting for their own advantage,
we just need to put some effort to see how we can close certain loopholes and make better for us, e.g. labour subst, was big loophole, thank god itz closed now,

Just a question, why is everyone so happy that the CIR has Failed and more importantly why does everyone on here feel that if CIR is resurrected it will "haunt" us?
If CIR fails to go into "production" this year, is it not true that we have ZERO reform? I mean would it not be better to ride this wave and try and sneak our provisions into the mix rather than SIMPLY feeling happy that CIR is "dead"?
At this point (even after the PD movement), About 70% of us are still in the retrogression mess and will continue to be in that mess till SOME immigration reform passes. So the question then is: Should we not be trying and praying that CIR passes WITH our provisions (and i know how hard the core team is working and hence i am asking this question). I mean the core team has given an infinite amount of time and energy to this project. Would it not be easier to see a bill finally pass and try and get our provisions in this bill rather than killing this bill?

Now I-140 stuck , though his date date is current can't do anything except getting frustration.

Now that it is clear that we can file 485 without 140 receipt notice, I want to know what you guys, who have not received 140 receipt notice yet, are planning to. Are you going to file 485 right now with the information insturcted by USCIS (brightly colored paper...)? Or are you going to wait for the 140 receipt notice until certain point and then, if you still have not received the receipt by then, file 485 with the information insturcted by USCIS (brightly colored paper...)?
I think we can wait till Aug 15th for I-140 receipt and if we don't get that (:( :mad: :confused: ) then we can file I-485 with the mailroom instructions from the FAQ (:) :) )

Again, the bulletin mentioned beginning July 2. Every day, any day, starts at 12:01 AM. July 2 is no exception.
I Feel that what USCIS will do next is not return any application back to sender but DUMP them in some backlog storage room like BEC center and people hAVE TO WAIT FOR NEXT YEAR VB in OCTOBER IN ORDER TO GET RECEIPT NUMBER BASED ON PD AND THEN THEY WILL GET EAD and AP.
