Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.

My 485 application was also received my USCIS in second week of May '07. Does this mean that they have alloted visa number to me as well? I am confused :(
According to him, we do. I'm slightly worried but not excessively so. I think we're gonna be ok. I'll call again in about an hour, so check back on here soon for my update.

Look at the unity in our diversity...for a moment while reading some of the comments I forgot I was in the US and looking at an supposedly elite forum...Bravo!! Keep it up Indians (Tamilians, Gujaratis, Marathis, Bengalis, Biharis, etc..)
One more thing, if you are upset with a person who misbehaved with you (in this case, rudely told you he didn't know any language other than Hindi), then logic tells me I should be upset with that person and not the reason (in this case, language) itself.

I've had people tell me very rudely to talk in the native languages of these areas and I've tried, sometimes successfully and sometimes, not so much. The rudeness of a few members of the community never led me to form a general opinion. I've very close friends from all over India.

In 70s most of the towns having only local language schools and stuided in local language schools , thay may be part of reason why some of them dont communicate well ..That doesnt mean they can not work on computers ...

EB2 is the only hope for all EB3-I folks bcoz EB3-I is last in the chain to get any spillover so you should not have any hopes in next 5 years.
Dates will move one month per year for EB3-I in next 5 years unless a miracle happens.

So if this bill is introduced as a new one with a new bill number, does that May 15th provision still stand? Or is it now gonna be June 19th ?
Section 501 (Rebalancing visa numbers and Z visa allocation) is effective on the first day of the fiscal year subsequent to the fiscal year this bill is enacted.
Here the fiscal Year is from 1st October to 30th September. If this bill is done within next couple of months, we are talking about 1st October 2007. This is my interpretation.
Section 502 (Merit based system) is effective from first day of next fiscal year after this bill is enacted, provided it is ateast 270 days away. So I am guessing, we would not see Merit based point system till 1st October 2008.

Six years on my H1B expire in April 2008. I just got laid off from company A. My last day of work will be May 31st. I have LC and I-140 approved with company A.
If I join company B starting June, and transfer my H1B to B, can it extend my H1B beyond 6 years based on the approved I-140 I had with company A? If yes, will it be for one year or three years?
Gurus please help. I will be grateful.

Kindly note that my suggestion to look for other opportunities is ONLY directed at youngsters in their early and mid 30s..not for people like you are me who are in this mess! i left UK and came here ...that was a GREAT and WISE decision!!!! ha ha ha !!! Not necessarily getGC. I am EB3 but i am a Masters from the US. Sometimes for fresh hires lawyers play it safe by applying in EB3. I had emailed someone at competeamerica.com and they had mentioned that an "advanced degree" is either a masters or a PhD. You mentioned that you had an engineering degree from India. Is that a B.E. or an M.Tech/M.E.? If you have a master's degree from India, you need to ask ur lawyer if that qualifies as an advanced degree.
But even otherwise, it still benefits you, coz say even 20-25% of Current EB3 have master's degrees, they will be out of the queue and you will be benefitted. I know it doesnt sound like a benefit, coz it is not a direct one, but if you look at it from a different angle, you will see it.

I called couple of Desi consultancies..and they told me that lot of thier I-140's aqre getting rejected in this conversion drama...since they are looking for finanacials of the companies and looking for $3 mil of profits..? well do you have anybody who successfully converted from Eb-2-3 please IM me which companies I could contact...
