Good that the GOP nominee for the Senate in California is taking a centrist position, but its annoying to hear about being opposed to amnesty. So is just about everyone who favors comprehensive immigration reform. The question is not whether you're against legalizing people and not punishing their behavior. None of the versions of immigration reform introduced in the last five years do that. I am paranoid about losing my GC with me since I have on more than one occasion left misplaced my wallet, or left it at a restaurant, friends place, etc. Thankfully it has been returned to me with all contents intact and untouched every time. I do know that my luck will eventually run out so my question is this. Can I carry a photocopy of my GC instead and probably leave the original locked up in a firesafe at home? (I do not live in AZ, BTW)

Hi All,
I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me

i485 rfe for my wife. Please help
My wife received an rfe for the things listed below. I think she got it because her finger prints are not machine readable and FBI have not been able to verify it....
1) Submit true certfied copies of any and all arresting officers reports....blah blah blah
2) Other: Local police clearance Letter from every place you have lived in united states
My wife has been in US close to five years and lived in 2 cities
MY question is
for 1) she has never violated any law so does not have court disposition or anything of that sort so does she need
anything for this?
for 2) She has resided in 2 cities but also stayed in India for 4 months.
The rfe clearly says "for every place lived in united states"
so I would think she does not need a police clearance certificate
from India
Please help we have till march 5th to reply this RFE

Hi,
I have been doing a lot of research about this online and have even heard from friends that if you transfer your H1 to H4 and apply again for H1, your new H1 application is not counted against the H1B cap. How true is it? Has some one done this before ? Is there any risk involved? Any help would be really appreciated.

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

1. I came to USA last year on H4
2. Filed H4-H1 in May 2005 through Company A
3. In Dec 2005 my company ( A) got merged with another company ( B)
4. My H1 got approved in Jan-06
5. Presently I am working and getting pay stubs for the new company -- B

Hi i've been reading the forum for a while now and I hope that you guys can help me out. Like most people i have more questions than answers.
I just got my i140 approved (Sept 24,2008 or so).
The LC was file around Apr/Jun '07 so i would assume this is the Priority date correct?
My lawyer tells me that while this is great, we still have to wait for visa numbers to become available to file the 485. Any suggestions on when is this gonna happen?
I know that this is somewhat linked to the visa bulletin ... how should i read it to understand in a few words, when is my time?
Once i've filed i485 how long does USCIS takes to process it?
On the other hand, i'm quite anxious about changing jobs. If I do, do I waste all this time invested in the process? any other way around that?
It seems like no lawyer wants to provide a straight enough answer. I know it's a lot of questions but i really appreciate it.

I joined company ABC on H1B in 2005.
In Nov 2006 company XYZ filed my GC.
H1B got transferred to a couple of companies because I changed jobs while GC was being processed in parallel without being affected by my job changes because it was filed by another company.
In Oct 2007 got my EAD for a period of 1 year. Kept working on H1B only though.
EAD expired in Oct 2008. Applied for a new card but never received it. Did not apply for one after that.
In Nov 2009, I quit my job and moved back to home country giving up my H1B while still not affecting my GC because company XYZ agreed to keep it under process.
So at this time, I have no H1B and no EAD card. My priority date is however going to be current soon.
Now...
1) Do I have to be in the country before my dates get current or can I do that later?
2) On what status do I enter?
3) Can I delay the process somehow without affecting my GC?

I had a really good experience in Nogales last week, I got my visa stamping on the same day of my appointment and the NVS International team was great. They arranged everything for me:transportation from the Tucson Airport to Nogales, they arranged my hotel stay, bank draft as well as transportation from the hotel to the consulate.
