Hi All,
I have applied I-485,I-765 and I-131(AP) for my wife as derivative when my priority date(March 26th 2006) became current on September 1st.
We recieved the Reciept notices for I-485,I-765 and I-131(AP) for my wife on September 30th.
My I-485 got approved on 11/05 .We didnot recieve FingerPrint notice still.
I would like to know how much time it generally takes for derivative I-485 approval .

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.
Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

Hi,
I have two H1bs. I was working on first H1 till 02/2007 , i moved to second H1from 03/2007 . I am planning to go back to my first H1b which is valid till 03/2008.
Is moving back and forth on these two valid H1 is possible? If so what steps i need to follow.

Hi everyone,
I need a suggestion . i am working on virgina state. and my employer is running the pay roll on newjersey state. I am sending emails to him but replying. I am working on from last year for that company. He is having backup amount (caustion deposit) nearly 7000$

Hi,
I am working on L1 from Company A.
I have applied for L1 to H1 status for year 2008 from comany B. H1 got approved without COS. As COS not done, I continued working on L1 with company A. Now my L1 is getting expired on Aug 2010 and my L1 company want to extend L1.
While applying for my L1 extention, my H1 applival cause any problem.
Please help me to get more info on this. Please let me know if you need more details on this.

I'm sure the lawyers have already told you that this is not possible. The company cannot refile PERM now because all the ads, posting, etc are too old. They would have to start again.

The company can apply for her H-1B on or after April 1, assuming she is subject to the cap. She will be cap-subject if she has never held H-1B status before, and if your company is not cap-exempt. Assuming she and the position meet the usual H-1B requirements, it should be approved for a 10/1 start date.

it might be a little bit tricky to find this out. Talk to IO about your 485 and ask her about 140 during the conversation. She might tell you the PD on that. Once, I successfully reconformed my PD by trying this way ( I have approval notice with me though).

I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?
As long as the payment comes from/through the company that is sponsoring your H1B, you're fine.

I find that just importing my Swift3D output into Flash and then exporting it again I can reduce file size from 50 kb to 5kb. and usually this is good enough.

This is urgent please advise,
I was planning to join new empolyer with my EAD. I gave my Labor certificate to my manager, some how things are now going well with my new employer manager. Somehow I am in double mind whether to join or not join this new employer, I was just worrried since he has my labor certificate he can negatively affect me , if I do not join this new employer. Please advise if he can negatively affect me any way, or what precation I need to take in case I do not join him.

I had an H1 for about 3 years (2 different employers), and then was hired by an international organization. I gave up the H1 and got a G4 visa, which I still have. Over the last 3 years with a G4, my credentials have changed, and am due to get my masters degree in May 2008. If I were to move to a job requiring H1 when I get my masters, will the total number of years allowed for me to hold an H1 roll back to 6 years? I'm thinking that since the skills I had as an H1B visa holder before have changed now.
