hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

Some decisions and cases support that a corporation even if it is owned and operated by a single person may hire that same individual in an H-1B capacity. This is based on the concept that the corporation is a separate legal entity fron its owner. However, self-sponsored H-1Bs are subject to careful review. My I 140 approved under Eb3 if i want to change my job and my employer is willing to do in EB2 can I use my old PD from I140 EB3 ?

If H1B extension gets denied and my employer will appeal it. My questions are
1. Can I allowed to work until I decision is made on appeal?
2. If appeal is denied, from when I will be consider as out of status? (from I-94 expiry date or appeal decision date)
3. After appeal denial what is the grace period to leave the US?
4. Can same employer is allow to file another H1 petition for me?

This story really makes me happy. I just wrapped up a dozen years of service on the board of the Hebrew Immigrant Aid Society, the organization that helped my family and my wife's family immigrate to the US. you can claim him if:
1) He didn't earn more than $3500 in 2010
2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)
If you paid for his tuition, you may be able to claim tuition credits for him too.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.
