I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?

Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.

How funny is this? My PERM was filed for Tech lead position and I am getting enquiries for PM position and I can not take it whereas you are trying togo in reverse direction. Anyways... you can not come in reverse direction now. The SOC code for Tech Lead is '"15-1031 Software Applications Engineer" which is definitely different than Computer Systems Manager and I believe logically management stream is altogether different than technical stream. Be very careful and refer to attorney at law before you make the decision.

It is possible to approve I-485 if I-140 is approvable but is not approved. One of my friends got his GC this way.

One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.
If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

I was just pondering on why Madame Pelosi has not woken up from her slumber and acted on the letters that she is recieving . I can count 10 letters from my relatively short memory . Wonder when she will ACT and stop recieving and filing letters . JUST 54 days are left in 2007 . :eek:

I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!
If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

Has anyone traveled to India by Virgin Atlantic connecting to Jet Airways at London ?
The ticket is from Virgin Atlantic (through ticket, Jet is their Code Share) .
For baggage rules, Virgin website says --
"Any passengers travelling from India to the USA, (and vice-versa), with Virgin Atlantic for their entire journey, which involves a connecting flight via London Heathrow, will be entitled to an additional bag up to 23kg ."
I sent them an email before ticketing and they replied I am entitled to two piece.
When I contacted them after ticketing , they say I am entitled to one piece. Logic was London - Mumbai is by Jet Airways (but my argument is the ticket shows VS flight number).
Does any one have any experience ?

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill. I believe they promise a 15-day (business days, I assume) turnaround on Premium Proc applications. So it could take anywhere between 1 and 15 days, if not longer in certain cases.
Also, why is going to India dependent on receiving on an approval of I-140??

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

Recently I applied for AP. It was approved on Oct 20, 2009 but when I got the document from USCIS I found that the effective date of my AP is from 12/20/2009 to 12/19/2010. My question is,
1. I want to go to India on 26th Nov and return on 20th December. Some of my friend told me that I can travel between 12/20/2009 to 12/19/2010 not not before 12/20/2009. Is it correct.
2. My understanding was I can go to India before effective date which is 12/20/2009 and can return on or after 12/20/2009. Is this correct.
Please respond as I want to go to India on Nov 26th 2009 due to some emergency.

you do not have to apply for COS, if she wants she can get h4 stamped when she travels, but is moot anyways as she plans to use EAD anyways nullyfying her H4.

Now that we have media attention with USCIS we should start letting Congress know of our plight too. Vice President who I think is the chair of the senate and Nancy Pelosi, House Speaker.:D
Adding whackiness to it. How about creating just one big huge monster greeting card with all the signatures from affecting people and put it in front of white house or some place we get the attention.
