In 2002 all the EB visas were issued (174,968). However, there were 31,532 unused family preference visas, so the limit for 2003 was 171,532 (140,000 + 31,532).
Guess what, in 2003 they only approved 82,137 EB visas, so they ended up with 88,482 unused EB visas
From where did you get 174,968?
Is there any case where unused FP #'s were captured for EB?

There's no law that employer should borne the cost of GC.
I suggest you talk to your lawyer first. The cost of Labor and I-140 should be borne by the employer as they are employer's petitions.
I have spent almost 10K in my GC process until last year and 2K this year for EADs and APs.
2K for EAD and AP this year alone! Let us see how many people on this forum has spend that much on EAD and AP. Paying high legal fees is NOT a basis to seek remedy.
I spend about 3 K in one more GC process I started several years back which I abandoned because I changed the emloyer.
That was your choice.
I Spent 1000s of dollars in Visa stamping, H4 renewals. And yes I'm stuck for almost a decade.
H1/H4 and Green Card processing are not related to each other. H1 is for current job and GC is for the future job.
There are at least 10 people I know who are in similar situations, so I'm guessing there'll be thousands in USA. These are facts it may not apply to you but does apply to lot of people here...
One hand, you are saying guessing and still insist that it is based on facts.

I was kind of oblivious and busy in my work since I applied labor and was thinking everything will fall in place gradually..
I registered to this site today and just read this forum.. ..and ..simply freaking out
My attorney applied my Labor in Nov 2006 (according to him) in Atlanta and I still dont have any response no audit .nothing .it is just in processcan u believe it?
can I do something from my end
I hope 140 and 485 is still not in retrogression state . Do u guys know how long it will continue to be in this state

Yes the bulletin is pretty detailed. Explaining logic behind per country limit and movement of cutoff dates. Certainly a first in a Visa Bulletin.
Needless to say, CIR with provisions to address this backlog is the only hope for both i REITERATE - BOTH EB2 as well as EB3... divisiveness will certainly lead to failure or atleast a never ending wait for some of us....

The July 2008 Visa Bulletin has said Exactly the same, but in different words, what I have been saying for the past few months about the EB2-India and EB3-India Movements.
EB2 India will move very fast till 01 JAN 06 as because based on June 2007 bulletin, just before the july fiasco,( http://travel.state.gov/visa/frvi/bulletin/bulletin_3236.html ) the PD for China is 01 JAN 06. That means in EB2 Category except India and China every other country is current. So till India reaches 01 JAN 06 PD in EB2, all the spill overs will be moved to EB2 India, because the spill overs will be alloted based on the priority of old PD(Priority Date). By the time India EB2 reaches 01 JAN 06, China PD in EB2 will move further from 01 JAN 06 by using its 7% quota. So Inidia PD for EB2 again moves fast till that changed China PD using the spill overs. After that India and China will share the spill overs based on the PD priority. All this happens if and only if the USCIS works effectively and uses all the available visa numbers for the present fiscal year. My prediction for EB2 India PD is it touch 2005 /even cross few months in 2005 by the end of this year if USCIS works effectively.
For all Eb3s along with EB2s with PD after April 2005, the movement in the coming visa bulletins wont be much encoraging unless the new Obama government does something significant about employent based category or immigrationvoice does a fruitful lobbying. The doings of something by obama government to employment based category is not in our hands. The only thing we could do is to help IV and help ourrselves by contributing to it to reach its financial target for better lobbying. Or else wait for the Visa Bulletin every month with great hopes, sorry dreams, for your PD to become current, and satisfy with your EADs for years ahead.

Great job Milind!
Keep it up! You should be our "guest of honor" at the rally!
How about we build a "wooden" chair and carry you around at the rally? Not to mention lots of flower garlands! :)
What do you say folks?
Thanks dtekkedil. Now you are stopping me from coming to the rally. There are other people who deserve this honor more.

dude..dont rain on our parade...everyone knows the harsh realities.. i myself said earlier that only half the battle is won...but the least we deserve is one day of hope.
Congrats EB2-I !!
I guess the intention of DOS was to enable Consular posts to approve as many EB2 cases as possible inorder to minimize VISA wastage. And also continue to enable USCIS to pick the low hanging fruits.
Otherwise, I dont think USCIS has cleared all pending cases with PD earlier than April 2004.
Yes, EB2 definitely deserves this moment and at the same time EB3 I does not deserve this 'coma' stage in their PD movement.

I would be the most happiest person if that happens :D
NOW (no order whatsoever) is what applies during that last quarter.
So, it doesn't really do anything for certain for anyone - except get us all on the edge of our seats "while supplies last".
Well, good luck to all! Let's see what happens.

This bill is purely on the theory of Common man vs politician
What is a politician?
Politician is a contaminated breed of Human species. Here's the difference.
When a common man see the problem, he tries to make a resolution and tries to make a permanent solution helping everyone.
Now what does a politician do.. he see a problem and think how can he pretend to get a resolution while trying to make use of the problem for his political advantage hurting everyone and even hurting who were not effected by that problem and then use the same cycle to resolve the residual problems of the so called "solution" for his gains.. and this goes on and on and on.
Moreover the worst part of the story is no matter where you go in this world, you will find this weed growing everywhere and there is no weed control chemicals to kill them and surprisingly common man is a fertilizer to grow it.

All,
When this July bulletin was released, I had given the following points in that thread.
I am seriously considering this. Indian economy is going to go leaps and bounds and I dont want to miss out on that. And wait here in the whims and fancies and their ridiculous illogical visa bulletins by these people. They shouldnt harass and take Indians for a ride. We are paying our taxes and all the fees and what not. Still they prefer illegals over us.
Enough is enough. I have self respect.
Looking at this visa movement for the past year and the current economy, I am just giving up hope to get GC in this country folks.
I am seriously thinking about going back to India. The reasons I was proding over are:
1. Well.. first and foremost, no hope of visa movement in near future.
2. Employer uncertainty. The company is not doing too well.
3. Tough job market and US economy will drag like this for another 2-3 years.
4. If they lay me off, I will have to find another job first. I havent even applied for 485 yet, so no EAD and priority date is Feb 2008
5. Restart GC again which is another excruciating process - moneywise, timewise.
6. Wait again in the line for visa movement
7. No career advancement because cannot jump companies and I am already early 30's. (I am non-IT). Career is stagnant, company doing very small projects.
8. Cannot even think of having kids because job and life here is hanging by a thread.
9. Cannot buy a house in this market. Its not that I dont have money, was thinking, if I lose the job, I wont get much time to sell it off and I will have to incur losses.
10. India is doing well and going to to do well in the future.
Is anyone else thinking on these lines?
Hi waitforevergc
You say that you are in non IT
If you don't mind which area are you in ? Oil/Mining/Finance sector ?.
You can try the Canada option like me. Lately Alberta/Canada closed
the door for IT people, therefore I am wondering if you have other options in Canada.
