In a weird way, I feel this is good news. An old saying in China says 'Things will turn to their opposite at their extremes'. The moment before dawn is the darkest hour of the day.
I agree. I think we can use this statement to show our plight to the media/congress. A doctor, engineer, lawyer, scientist, etc from Chindia have to wait for decades to get a green card (that too under EB-2 category). If we use this properly we might have some legislative change even in the absence of CIR.
Also, I read somewhere that Janet Napolitano recently signed something which granted deferred action for two years to widows and widowers of U.S. citizens-as well as thier unmarried children under 18 years old-who reside in the US and who were married for less than two years prior to their spouse's death.
I am sure something like this can also be done for us who have been waiting for years for our GC's.

I just registered for IV. I wish I could come to DC rally on 18th. But due to certain unavoidable circumstances I may not be able too. Though not an excuse But I feel very guilty about it and this guilt will always remain there that I was not part of rally on 18th. It's call reseach topic.. We have to find some USCIS support documents for each case. We need some earlier USCIS decisions for each senarios/theories.
RG provided few supporting CIS rules in earlier post and seems logical. But not sure if RG or RK is right.
It's confusing indeed.
One of IV members 'lazycis' (he is a knowledgable & senior member) also mentioned this, which exactly matches with what RG said:

Called them 3 times and everytime the same answer "pending and processing."
Unfortunately my uncle passed away yesteray and I have to travel for the funeral processings. Called USCIS just now and told them to expedite the case. CSR took all the information and told that someone will contact me within 5 business days about case. Hoepfully someone calls/emails and approves my case.
Just wanted to share my experience.

Yesterday I contributed $500 one time.
Today I have scheduled $50 per month as well.
I agree with those who say IV should start taking a Membership Fee. Even a token amount of membership fee like $10 per month would make a huge difference.

For all those who have sent PM.... Please note I am not an attorney or accountant... But then I had consulted my account and few attorney's ( paid the required fees to get them answered)... So please use your own judgement/caution.
1. Yes you can open a LLC singly or jointly with your wife/friend/anyone.
2. You can start the LLC even when you are on H1B but it is better that you wait till you get your EAD to get oprationalized. reason very very conservative view is that you cannot even write a check for your company or deposit a check... but this is a very conservative view....
3. To open a LLC you can use an accountant ( if you have one, it will be cheaper by a couple of hundred dollars) or use agencies like www.legalzoom.com/legalzip/LLCs/llc_procedure.html .... I have used both in the past....
4. Intially you can just form LLC as single or joint partnership and then elect as S corporations for taxing.... I forget within which period it is to be done, if I correctly remember when you file your first tax return or within 6 months you need to elect as filing as single person entity( then it becomes like your personal income) or you could elect as S corp....
5. You will a tax id for the LLC, business license and other documents when you form a LLC, You will need to maintain book and tax records for 3 years... best to have it managed by an accountant
6. You/ your spouse can work for your LLC.... Some of you if you want to after 180 days change employers can move into your LLC and maintain that you are employed in same occupational duties for your own LLC...

As Ron Gotcher observed, they are still using DOS ( not department of state ! ) programs .
Well they do process millions of applications - H1's , EAD's , GC's ' I-140 , Labor and so many different kinds of visas and other applications . I must say that they are trying even if they are not succeeding. It is probably due to shortage of manpower and experienced personnel. Another problem is that the money that they get from all the application fees which is a very significant amont ( greater than a billion ) some of it is diverted to other programs rather than hiring more workers for USCIS .
I guess we can only make efforts via rallies and other actions that IV does to make them realize the delays and streamline their process but the ultimate decision will always lie with USCIS unless a big political figure steps in .

When do you think would EB2-I hit Feb 2005? Before this year end?
Perhaps not. With many I140 getting approved, there are always chances of dates going back instead of moving forward.
I can think of average movement of one or two months moving forward per quarter. The two bills in pipeline can ease this situation:
1. Removing country quota
2. Recapturing of unallocated GC Visas

Its confusing whether EB measures will remain in Mr. Frist's bill or not, as following statement contradicts to that he will striped out only guest worker provision for illegal aliens:
Sen. Majority Leader Bill Frist plans to introduce a bill that deals solely with border security as early as today.....
Let's wait for the bill and hope EB proposals remained...
If majority leader Bill Frist bypass Judiciary committee and introduce enforcement alone bill, EB proposal will be there? It also reported that this bill have Senater Arnel Specter proposals and striped out guest worker provision for illegal aliens.
Does this means that Senater Arnel Specter's proposals on Employment base immigration remain in that bill?
If yes, We don't have to loose anything.
Please post, if some one have information

My understanding of the 1-485 processing is that there are several things that they do and checking the PD is the last thing they do to issue a GC.
The RD is the order that they follow until they find out if your PD is current. As for moving by RD, I have noticed that movement in NSC for the last 6 months has been really slow. And now, with so many more apps pouring in it can only get slower. But given the fact they are under the microscope right now they might just kick the tires and processing may pick up speed for a few months. This will benefit all the ppl who have been waiting for 485 approvals for 6+ months and their PD's are really (g)old. It might also benefit recent filers in getting EAD/AP sooner. But all of this going to be very political and can swing either way. So I wouldn't bet my money on either side and/or logic :D

I personally believe that PD is more significant than the RD but it makes sense to me that RD may take precedence if the PD is current (as suggested by some members of the forum).
But if we think that at all times RD is the order they process them what would happen in this scenario
1. A guy with 2001 PD filed later and was 750,000 th guy in the queue of AOS applications.
2. After accepting all the apps USCIS retrogressed the dates to 2002 Jan. That means that USCIS is asking for AOS apps which satisfy this PD. That means that a visa no is available as of that date for adjudication so the first new application received(after they are retrogressed) will be 750,001 th application.
3. If RD is the only processing order at all times then 750,001th application will not be sent to an officer for review until all other 750,000 th applications with a better RD are processed.
4. Assuming that this takes 3 years (for example) then they are accepting an application today which they are not going to even look at in the next three years and this is not making sense to me.
5. If they are accepting the 750,001 th application because that application qualifies for a visa no then that should be processed before the other applications(barring for special cases FBi name check issues, RFEs etc). This means PD comes into picture when there is retrogression. So then they have to apply the same rule for the I-485 applications which are pending with them. They some how have to order them on the PD and I assume this should not be rocket science for them as that data is part of our AOS applications.
