YES Baby!. I am making it to the Sep 18th DC Rally. I am also bringing my parents (who are visiting US) along with me to the rally. So, total count is 3.
Initially, I was planning to take them to just NYC. Now I changed plans and decided to show them DC as well. Since we are talking about Washington Monument and Capitol Building, I don't think they will mind at all :).

anyone else having problem filing EAD & AP in time with fragomen, pls share.
Is fragomen filing EAD & AP on time?
I have been following up with them to file my EAD renewal since 10 days and today I received a response that they are busy with audit and will do as soon as they can, I don't want my ead application to be delayed, its already more than a week I was eligible to file EAD renewal.
Anyone else having problem or I am the only one?

The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.

You are wrong here. Equal Opportunity Law does not apply to Immigrant Visa allocation. PERIOD.
Example:
Employer XYZ has 3 employees on H-1B. Its upto Employer's choice to file green card for any or all of them. Employer may decide to sponsor employment based green card for only 1 of them. This is perfectly ok and does not come under employment based discremination.
Like I said multiple times, spend some real money to get professional advice from attorney. May be that will enlighten you. Talk is cheap and so is being in dremaland.

I was told that people on H4 are not eligible for SSN, and if I want she (the person on counter in ssa office) can issue me a denial letter for that. It sounded useless to me that time, so I didn't bother to get that letter.
This idea sounds good to me, I'll go to SSA office again and try to apply. Offcourse they will say that they can't accept application. So I'll get a denial letter and I can appeal against that.
They cannot refuse to accept your application. Fill in the forms and send them in. They can deny your application and then you can appeal. If they refuse to accept the application, you have two options. You can contact your congressman and complain. You can file a discrimination complaint with the SSA ombudsman. Here is the discrimination form.

Finally, if you believe you have been denied your rights because you are an immigrant, you can contact your local ACLU and ask them to represent your case. As a last resort, you can file a lawsuit at the federal district court. The filing fee for this is $350. However, I hope we are all doing this to exercise our rights rather than for the money. It is very easy to write but difficult to do. Except for IV folks there are hardly any fighters out there for our cause. We have all seen the result....CIR that favors ill-legals but decreases visa numbers for the EB cases.

It�s good that at least some of us are getting VISAs, instead of VISAs being lost.
However if this continues we could see a big movement to switch over to EB2 with or without porting PDs. This may in turn help EB3 :)
We need to make this a sticky thread, so that we can brainstorm and put best ways to switch from EB3 to EB2 w/keeping older PDs.

Me and my wife had each sent a letter on Feb 10 to the President and the IV PO Box. I did not see my id in the names of peeps who sent a letter.
Just posting here to make sure you guys got the copies I sent you.

Yes immigration reform was on many of their lips....all we can do is hope they consider it sooner rather than later...but who on earth trusts politicians. I am still thinking that the embittered Democrats will try to strike hard blows to pave way for a Democratic President in 2008...that is going to be there main agenda - by repealing tax cuts, calling committees on War, etc to take the Pres to task....They have called that out too many times...for us to ignore that it will be their # 1 priority.

any help with my queries is really appreciated.. :confused:
A very surprising thing happened in our company today. Shocking it may seem, they laid off 5 employees in my department today without any notice. Today's happenings makes me want to gather as much info as possible in case something unexpected might happen.
I am a July 2nd filer of 140/485 concurrently. No I140 approval yet. Received AP and EAD for both me and my wife.
If I request my employer not to revoke I140, will I be able to use my EAD for my next job?
Can someone give suggestions on what other options I have if something terrible happens to me?

2) I don't think there was any core member yelling, just a bunch of enthusiastic supporters. But I appreciate the feedback and understand the frustration. It takes different things to motivate different people, which is why I am looking for real feedback to improve moving forward. I'm sure you understand, politely asking once or twice many not get through the flurry of daily posts that happen on this board :)

Current Status: Card production ordered.
On June 29, 2008, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."
Then by the evening my I-485 said
"Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Notice mailed welcoming the new permanent resident.
On June 30, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register."

In such cases, where the InfoPass people (IOs or VOs or whatever they are called) pass judgement on whether your 485 should be approved or not, does it help to bring a printed copy of the AC21 Aytes memo (issued in Dec 2005)along to show to them? It is an official USCIS document and it clearly states the following.
Question 11. When is an I-140 no longer valid for porting purposes?
Answer: An I-140 is no longer valid for porting purposes when:
A. an I-140 is withdrawn before the alien�s I-485 has been pending 180 days, or
B. an I-140 is denied or revoked at any time except when it is revoked based on a withdrawal
that was submitted after an I-485 has been pending for 180 days.
Well - what is the point? I will take all documentation if it is an interview, in fact I will take lawyer for interview. When you go for interview, take kids and spouse and lawyer - don't go alone.
One must not expect much from Infopass. If you get info - great if not - jst leave it.

Since my gc approval, I've been in and out of the US, and I hadn't had any single problem getting back in.

My current employer has assured me that they will not revoke my LC or I-140. It is a huge company and I think it will stick to its word. It will not have any use for the LC, I-140 anyway as the whole group was laid off and the product moved to India.
So, it seems that if I transfer to company B they will be able to file for an H1 extension beyond 6 years based on I-140 approved with company A. I can then start my GC process with B again while keeping my old priority date.
Once again, all your replies were immensely helpful.
