This is a different employer, so I am assuming it is new H1. If I remember correctly from my past research, H1 is always NEW when you file it with different employer, but I am not 100% sure....

I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.

One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.
I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.

Make AF flight crew wait it out in some mosquito infested lounge for 10 hours before clearing their immigration. Call it something like quarantine for French swine flu or something. But do give them a bottle of water and enough spicy Indian food. :D

BTW, I used to stay in France (and Holland 98-2000) and had a fairly good experience when I was there. Never really felt any racial discrimination. Only thing that they want you to do in France is try to speak French that's it.
I bear no ill will to the French or the other EU folks. This is a fight with the Airline and let's keep the discussion to that. :)

I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.
He is over 6 foot, in immigration voice t-shirt and blue jeans. He is swedish...Please share his name if anybody knows....

The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...

This is for the ones who think that the discrimination based on EB3 or Eb2 is a bigger issue! I would not get into the discussion on why I think that IV is not just about EB2. Also, on our forums it's about reality and not empathy, which everyone should understand.
Now having said that, please direct your energy towards elimination of country limits rather than fighting a fight which was in your past. Why your company put you in EB3 and not EB2 is not something USCIS or US can control anyways. But when you are EB2 or EB3 with same qualification, experience and expertise compared to someone from say Europe, Australia and many other countries but China, India, Mexico and Philippines than why should that other person get it before you do when you applied before him???? What is America getting anything different from this other person?
Now talking about diversity for country limits India is more diverse than any other country in the world! And hey, most of them are already here in the country and waiting in queue, how is this helping the diversity?

trouble is that labor certification is not explicitly mentioned in 406 (although that seems to be the intent). Besides, section 405 says that those with "advanced degrees" in STEM and who have been employed on NIV can directly apply for change of status subject to per-country caps .. then again there is mention of a special labor certification process for those with advanced degrees. So i think the conclusion is that while labor certification wont be done away with , there will be special handling for those with STEM degrees .. and those with 3+ years experience AND STEM degree wont be subject to per-country limits.Again, lots of ifs and buts in the whole thing .. we will have to wait and see.

Even if big companies r ready to pay that kind of money for H1B employees - almost all the big companies - not just the tech ones - almost all depend on the body shops to provide contract labor- just think of it - banks, insurance companies, telecom, IT, utilities - take the example of just new York city - half of Wall street depend on these bodyshops for software labor - if majority of the body shops close down - this labor supply will be stifled and that will pinch the users of this labor supply - so extreme restrictions will not help the industry as a whole..eventually I think these Sanders/Durbin restrictions will be watered down - in case the bill passes the whole COngress

We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.
Our angst, our insecurity:
Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.
Early effort wins:
The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.
How you can help:
You and help in two different ways:
Join the advocacy effort in DC on June 7th and 8th. Corruption is everywhere equally - US and India.
Difference is how they do it. US, its what they call it legal corruption. In india, we truly follow the meaning of corruption ( illegal ). Better this way.
Examples

Phones - In US, you want to connect, disconnect, block, unblock - everything has a God Damn fee.
Banks - Same damn thing.
Trollies in airport - You dont pay for that in India ( 3 dollars you pay for trolly, 50 rupees to cooley in india, hey i save 100 bucks )

No, it isn't NC and NC alone. The percentage of people that get stuck in NC is minuscule compared to the back log due to inefficiencies.

I totally agree that USCIS is inefficient in using all the visas allocated. DOS provides cut-off dates based on the projection given by USCIS. USCIS always on the defensive and provide the cut-off dates that results in such waste in EB visas every year. I do not think that they are ready to learn from their mistakes, otherwise how come this is a regular issue every year? Even a small relief like using the entire visa allocated will be better in such retrogression.
I hope USCIS will be made liable for the mistakes done in their past and provide those unused visas back to EB.

First of all I would like to Applaud the Consulate General of India - Houston for the phenomenal speedy service I received for my daughters PIO application via mail. I sent my application on Oct 1st 2010 and it's Oct 15th - we have already received her PIO along with our passports back!! All the information about delays which I had read online before submission seem to be rubbish.
Additional info: notarizing passports was hassle coz no one was ready to stamp the photocopy. Texan credit union manager made a letter with my passport information, took my signature and notarized it for free. I just attached the photocopies with her letter.
I sent the below mentioned documents from Dallas via $20 Express Mail USPS - with signature proof. Was delivered under 24 hours. CGI Houston returned our stuff in FEDEX.
For status update: I called the consulate 7 days after the delivery notification - (yes its tough getting through - but they do pick up the phone) the lady informed me the PIO card had been processed and will be sent soon.. Didn't realize it would be in next 3 - 4 days!

Additional info: notarizing passports was hassle coz no one was ready to stamp the photocopy. Texan credit union manager made a letter with my passport information, took my signature and notarized it for free. I just attached the photocopies with her letter.
I sent the below mentioned documents from Dallas via $20 Express Mail USPS - with signature proof. Was delivered under 24 hours. CGI Houston returned our stuff in FEDEX.
For status update: I called the consulate 7 days after the delivery notification - (yes its tough getting through - but they do pick up the phone) the lady informed me the PIO card had been processed and will be sent soon.. Didn't realize it would be in next 3 - 4 days!
