Hi,
I want to know weather can I apply AP for my wife while she is in US post it to India if she has to go to India before it gets approved.
As there is the situation my wife need to go to India in July and I am planning to apply for her AP, can I send it over to her once the AP is approved or dose she need to be present in US at the time of approval.

I just thought of starting this thread for people who did not attend. Please explain in one or two sentences why you did not attend. Whether it was a personal reason, whether u were scared, didn't care, forgot, didn't know! etc.

I really wanted a green card, but because India is growing so fast, I really don't think I want it so badly anymore. So, I did not have the motivation to go ...

Mirage..you are absolutely right...i paid 765$ as per old fees for I485,EAD,AP. the new fees for I485 is 1010$ and EAD,AP can be concurrently filed with no fees.also, since I485 is filed with new fees there will be no fees for renewals.so, basically 1010$ one time fee with the new fees structure and 765$+645$(EAD+AP) with every renewal every year.(if it becomes 2 years then for every 2 years).i wish i had paid thru new fees.this is completely unfair and big BS......

Hi Nat,
Fragomen took about 6 months in getting "prevailing wage info" for my case in 2001. My manager ( Canadian who had gone through US GC process himself) finally talked to them and asked them to file without waiting for DOL's reply on prevailing wage. (That was a risk but we agreed to take it at that point)
That six months delay costed me 6 years in GC processing ! But thanks to my manager , otherwise I dont know how many more years I would have waited.(One of my co-worker still awaits his labor cert !)
The big law firm goes by predefined steps , which are probably the safest way for most cases but may not be the fastest way. You need somebody who has been through this process and can understand and asks good questions to lawyers and can help lawyers to think for your perticular case. Check if you have somebody in your org to do that.

I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

We should not waste our time and money on this. I also would like to understand the lobbying impact of IV. After hearing tech lobby brought CA governor into picture and even that does not make any difference in favor of tech companies, are we making any impact with 200-300 thousand lobbying and some web faxes?
There is no question about IV effort. But the question I have is impact of that effort.

everyone here needs to realize we don't need to sweeping legislative reform to address our concern, all we need few guidelines to impliment current law in more sensible way,
we simply don't have resources/strenght to address this issue letz not fool ourself anymore and letz put our moeny where mouth is

I saw lot of posts above saying good things about them however my experience with them has been bad. I am assumng this is Fragomen, Del Rey, Bernsen & Loewy, LLP we are talking about.
There have been a couple things in the past but the most frustrating one was that even though I sent them all my papers etc. by Jun 20th (so that they can file it on July 2nd) they did not file my case until Aug 08. They are my corporate lawyers so I don't have any choice. Also, they asked us not to contact regarding status during this period as they were really busy. While not responding to status queries was understandable, they still took more than a month to file cases. I confirmed with a lot of my colleagues who were in the same boat and were equally frustrated with noncommunication and taking so long to file the cases. They also were not maintaining any apparent first come first serve queue because there were several folks who got their filings done much sooner than others who had sent complete paperworks way before them.
Based on my experience, I wouldn't recommend them.

I dont mean to discourage folks here...
But here is what I have seen more often with MBA. Techies like programmers, business analysts in IT sector have done their MBAs from good schools and ended up doing the same job EVEN WITH GREENCARDS.
I have seen GC holders doing MBA and then after finishing MBA ending up with same job description with a 5% increase in pay.
So please do your research in HOW MBA is going to help you in your situation. Your job and your INTENDED JOB POST MBA may not really need you to have an MBA. And I have seen this way too often. So think before you pluck down 30,000 dollars on a degree that might do little benefit financially after you complete it.

I share your concern, there were more than 905 in that period, I don't think the DOL data sheets have any data for NOv 04 to MAr 05. I'm not sure of the source of the original post...

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.
Another perspective is that if people with Masters or higher degree are exempted from the EB quota, it will in fact help in moving the priority dates current, since there are lot of people in wait who already have advanced degree from US universities and won't be using up the visa from the EB quota.

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.

Hi, we recently applied for COS to H-1B at California Service Center on May 26th under premium processing. So far we have not received even the receipt notice, neither have the checks been cashed. Just wanted to check with everyone if this is normal, or did they misplace the petition?

I work for one of the fortune 100 companies, to my surprise, none of my European colleagues is aware of all the GC process. All they do is just provide documents what ever the HR department asks for. They don�t pay from their pocket for GC (ideally correct). None of them has clue about priority date etc�.they get communicated by the HR department about their GC process.
So putting your case in perspective. I am assuming that the HR department would just hand over the GC to the employee. Neither the HR (I think) nor the employee (definitely) would worry about the PD being current.
Ideally if a law firm is point of contact for a petition, what would they do? Would they go back to USCIS and tell them that the GC is approved by mistake? I don�t think so but some one can confirm if they had experience otherwise.

I can join in Company B at any time once H1 Transfer done.

Assume I transferred my H1b to Company B my own (using Company A's two month pay statement), then after 10 days

Can I join with Company B ?

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

To say that someone from a lower class of visa and not from an "Oversubscribed country" (and I am assuming you mean India) is less skilled and less deserving than someone from a higher class and oversubscribed country is ludicrous to say the least. Each and everyone of us (and I mean "legal immigrants") have our own skill sets and contribute equally to the American society. As long as we are competent at what we do, then we are all SKILLED in our own way. The only real defining difference among the visa classes is the level of education not skill. To suggest one is better based on education alone is arrogance and nothing else!

The per country limit is to ensure that citizens of ALL nations have an equal opportunity to immigrate to the U.S. and not just a select few. The only thing that I have found unfair as far as immigration in this country is concerned is the politicians' focused efforts to do something for the "illegal" immigrants at the expense of the "legal" immigrants.
We are all in this together and the insults and innuendos that dominate this forum divide us so let's stop them and focus on the real issues!
