Having an approved 140 and a 485 pending for more than six months is the safe method of switching. For AC21, the key is to have your 485 pending for more than six months. You can use AC21 to switch employers after six months of filing of 485 even if your 140 is not approved. Its not a simple process but folks have done it.

WHAT ARE THE NEXT STEPS--URGENT HELP!!!
My MTR was reconsidered--what a relief. Here is the response:
"Service motion to reopen or reconsider:
In the case at hand, the I-485 was denied because the underlying I-140 was revoked. However, the applicant is eligible for portability consideration under Ac21. Therefore, the applicant should have been notified of this eligibility before any final adverse action was taken on his I485. Pursuant to Part 103.5, Title 8, Code of Federal Regulations, the denied I-140 petition referenced above has been reopened/reconsidered."
My attorney says that what this means is that only my I140 that was revoked is now open and they have yet to make a decision on I485.
My question to fellow members of this forum:
1. Has any of you recived similar response to your MTR filing against wrongful I485 denial
2. Please note that my case is slightly peculiar in that the I140 was revoked and aproved labor certification was substitued--if some one was in similar situation, please respond with specifics?

I guess this is the best thing to do, to upgrade my current EB2, and apply for an EB3. I hope this will expedite thins around here. Looking forward to more good things come.
You mean you are in EB3 right now and want to upgrade to EB2, right? Not the other way round?

Based on the instruction of the paper file EAD, you can file your application based on the state you live in. it is either nebraska or texas.

Check this thread which is dedicated to such questions. I think if you get married after your I-485 gets approved, it's a sign of trouble since your spouse will get into the family based category which is heavily backlogged for certain countries.

My pd is jan 2005 and i was waiting for the dates to become current.I am not married and will most probably get married by this year end[parents in the process of searching matches].my dilemma is whether to apply for 485 now or not.can i add my wife's name later on while the 485 is in the final stages of the process[say an year after the process began] or just before the green card is being dispatched etc so that both of us can get green cards.i dont want to miss this chance because i seriously feel that the dates might retrogress again.but if i apply and get a green card u all know how many years it will take to get wife to usa in family based immigration.somebody please clear my doubt.Thank you

I applied end of March online at TSC. If they are approving within a month I would have got approval long back and not today. It is not coincidental they are approving so that they can give 1 year renewal.

First of all let us applaud the effort and commitment of needhelp and the many other committed members of Immigration Voice. I think it takes a lot to sacrifice personal time for an effort that others may benefit from but who may not see or recognize it.
Having said that some of the posts on this forum are emotional responses. I think we need to keep in perspective that "galvanizing people to a goal" is one of the most difficult things to accomplish. IMHO chastising "wake up" call speeches is not going to help. That is not to say that some of what is being said is not right. But I ask why should we chastise anybody?
At the moment I seem to be the only member of the NM Chapter (hopefully that will change). But frankly, it took me more than a year to buy into Immigration Voice and it's value. I have only recently started getting involved. As I see it, if someone visits this website (even for an update or to read forum discussions - as I did) they see value in coming here. Recognition of value brings commitment. But that also takes time. Maybe a lot of people cannot commit in ways we want them to commit. Maybe a lot of people choose not to. We should wish all of them the very best of luck.
Should we be disappointed? Sure. But we should also keep in perspective that it is their choice and we have to be "okay" with that.
On the other side, I was pleasantly surprised that in 10 days we were able to collect 2/3 rds of our target for the omnibus bill. That is an awesome feat. People can choose to be part of it or not. It is really up to them. I know I will have stories to tell.
And to needhelp...don't worry you have plenty of support and if you keep at it you will find more success.

I know the discussion is about how many visas are remaining and we are trying to estimate it based on approved labour petitions. While the PERM data may be more reliable I have my serious doubts about the pre-PERM data. My PD is Jul 2004 and my case does not even show up in the 2004 MDB file. I think the 905 number is a severe understatement.

oh ya, so you have a problem with donor status? Why don't you start with your cable company and ask them why do they charge you any money? Why don't you ask the gas station, that why do they charge you for the gas? Why don't you argue with the cashier at Walmart about the bill you have to pay if you want something? Its easy to be dismissive of others. Its even easier to fault others and argue that just because no one shared the information, so I have license to throw stones at others. But being an Eb2 highly skilled humanity savior personality that you are, why do you need a 3rd class Eb3 programmer to show you that it cost money to get things done. Why can't you see that in last 8 months this nation was going under a presidential election and nothing got done on any issue, other than bailouts and budget? Why can't you see that nothing has happened in the Congress on immigration for any other group? Why can't an highly skilled highly educated chanakya of this planet not see that it is ok for everyone to praise some immigration lawyers who are known to deliberately delay green card application, but its not ok to ridicule someone sincerely working to fix my issue? Why is it ok for me to track my application all day and not complain even once when some tracker website is asking for money to have my question from a lawyer, but will not leave any stone unturned to put the "burden of proof" of innocence on someone sincerely working to stand-up for me because I am too coward to stand-up for myself?

The US Immigration Law is a nightmare.
Couple of years ago, I migrated to Australia.
The Australian laws are very clean and straight forward. There is only one application form with some very simple question and detailed instructions. Just fill up the form, enclose the necessary documents and fees. That's it. You are done. In due time they will let you know "YES" or "NO".
There is no need to feed fat-belly hungry sharks called "Immigration Attorneys" (of course there are exceptions).
Once your case is approved, you and your family are eligible for the all the rights (except Vioting Power) enjoyed by any Australian Citizen.
Once accepted, there is no official discrimination.
Here the US Government cries about anti-discrimination, human rights etc, but those are only eye-wash. They should take lessons from the Australians.

I got the LIN number by calling USCIS...but have not got the receipt notice till now...
As there is an A# on I-140 form which needs to be written on all 485, 765 and 131 forms....i hope i get it in a day or two....

The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!
