I believe that you will contribute about 5K to 401 K and if your employer also makes a contribution then that should take care of taxes. I guess the tax rate is roughly 10-15% as a non resident for low amount of money. I agree that patriot act may not allow you to keep accounts but 401 K is not a current account with easy access to funds.

What we get

Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

If your job profile demands seniority (which it must be - going by your EB3-2003 PD), you are better off refiling under EB2, instead of *just* (read just) spending couple of thousands on IV campaigns and beating up on people who are not contributing as much you have done to IV. That is not to say we stop contributing for the general cause. Don't misunderstand and start flaming at me, won't do any good.
I have not done this myself with the same employer, I changed my employer for a senior job position and I had also acquired a masters degree in comp engg from a reputed university before I became eligibile for EB2. But as a fellow IVian, who understands the EB3-I issue, I would surely advocate this not only to you but to all other EB3's with older PDs.

That's nothing new that Dems are pro amnesty. I am not arguing against that. Nancy Pelosi already said something in that regard I think. The problem is not ingrained in the airline . Most of the Europeans would rather cut each other than talk to each other . I worked in germany which is also kind of like France and they hate the French more than anything else . I had a magazine in my hand and was looking at a nice picture of a French car , my German remarked , that is a very bad car because it is 'FRENCH'. Hundreds of years of war and strife have left the european countries little fortresses in themselves who have their own little language and culture . English is not accepted or frowned upon in most countries , because English is the language of the British and we are not British .
Air France being an international Airline should have known better . Air France needs India a lot lot more than India needs Air France . We have hundreads of Airlines Vying to ferry our passengers across the Atlantic and could very well do without Air France . By the way I also transited through Paris once and has issues with language . People in France speak in French even when they clearely see that the passanger does not understand French and has no clue to the happennings .

2) I don't think there was any core member yelling, just a bunch of enthusiastic supporters. But I appreciate the feedback and understand the frustration. It takes different things to motivate different people, which is why I am looking for real feedback to improve moving forward. I'm sure you understand, politely asking once or twice many not get through the flurry of daily posts that happen on this board :)

Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.
Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.
Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.
I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

If EB2 community thinks they are going to get green card just because they got current, that shows how blind-sided they are about the process. Because getting current is only the first step. there are lot of members who have been current and have waited years to get green card.
anyway, I guess for the next 3-4 months it will be EB3 community trying to lobby for changes and EB2 members looking at visa bulletin.

That is the least or at least work with them for 6 months since that is what the law would require you after getting GC.

Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.

Got the letter last week and I am willing to contribute for this cause.
But if we are paying up I think we should find out who has the earliest notice date / number and use that to ask for the info that way we can avoid at least some of the backlog.
Even though I have voted for $25 contribution, wouldn't mind paying more if there is a shortage of funds.

How long is your current H1 valid? As far as i know, You can get your H1 extended with the new company till the present H1 date provided the pending LC is not revoked. Normally most companies do not specifically cancel the LC..so you should be fine.
As soon as you join the new company, apply for Perm.

1. I don't like the attitude that comes along with the people that speak it.
2. I just don't like the language.
3. I don't live anywhere close to a place where I must know Hindi to survive.
4. The Indian Constitution recognises English as a subsidiary official language.
5. If I have survived as long as I have without knowing Hindi, I'm sure I can survive without knowing Hindi for the rest of my life.
