I think you will have some benefit out of this bill, albeit, indirectly. This Bill will exempt a lot of folks with advanced degrees from US and non-US universities. All advanced degree holders from US univs. (STEM and non-STEM) will be exempt. So, a person with an MBA flus a 4 year bachelors from a US univ. will be exempt. Also, folks with non-US STEM advanced degrees who have been working in the US in a related field for 3 or more years will be exempt as well. The family members of such folks are exempt as well. Consequently a lot of folks currently waiting in the pipeline may no longer be counted against the quota, thus reducing the clog in the pipeline. ANother benefit out of this bill is that it increases the quota from 140K to 290K. There fore, you will definitely see some positive movement in priority dates for people in your and other similar situations (this is the indirect benefit I was referring to). It is very hard to say at this point how much the positive movement would me. It will all depend on how many people will be exempt from the quota.

My suggestion would be.
If your PD is After Jan 2004, you better get started and look for a position in EB2. If your PD is before Jan 2004, you wait and watch until end of this year and then make a informed decision. But in the long run , it makes lot of sense to be in EB2 if your job requirement is eligible for it.
Also take a look at the trend of the PERM processing. as per 2007 stats 40% of the cases got struck in audit process.

Last year, with Republicans controlling both sides of Capitol Hill, the House passed an enforcement-only bill while the Senate approved a sweeping legalization. With the two chambers moving in opposite directions, both bills died.

The Senate could take up the immigration bill late this week, beginning votes on a series of amendments expected to be presented by Republicans and Democrats. A final vote on the measure could come as soon as next week.
Senate passage would send the bill to the House, where it would go through a subcommittee that includes several outspoken critics of legalization.

All we promote is from Core and dicussed with State Chapter leaders onlyIf your statement has been endorsed by the core that they want a million number then forget about this effort.I am feeling sad that i was part of this effort.I am not going to be part anymore unless i see some direct addressals from core to do it hence forth.I wish your million signature drive doesnt drive away many more like me.

I am not indian, I am chinese, and I attended the rally in DC. I am so touched by you brave indian people. while I feel such a shame that we only had much less chinese there. part of the reason is that IV is originally indian club. we got the message but kind of lack the close organization.
anyway, I am also thinking about another rally.
1, it has to be on weekends, so everyone can come
2. it should be in multiple cities, from coast to coast, all major cities.
DC. NYC, chicago, LA, SF, houston, boston. reserach triangle, seattle etc, where professional immigrants lives most.
3. we need to make sure everyone will come, need good personal organization, not just voluntarily, we need personal contact, conversation, meetings ahead, level by level, to build a good "relationship" with each other.
yes, this is the hard part.
4. we really need to study the illegal immigrant rally last time, how successful they were !!!!
5. honestly, we didn't get much media coverage. shame ! nothing on TV, newspaper frontpage. but--- if we have a huge rally, everyone will have to cover us, pay attention to us. it all depends on us.

Hi,
I want to know weather can I apply AP for my wife while she is in US post it to India if she has to go to India before it gets approved.
As there is the situation my wife need to go to India in July and I am planning to apply for her AP, can I send it over to her once the AP is approved or dose she need to be present in US at the time of approval.

As far as I know, AP needs to be applied while the person is physically present in the US. Once it is applied and receipt notice has been received, the person can then travel. you can certainly send the AP to you wife in India.

Does any one has any Idea or back of the envelope calculation as to how many EB2 visas (for all countries) may be left for the remainder of FY'07?
The reason I am saying Eb2 all and not EB2 India, as most of the 485 applications filled in early July 485 were from India. Hence, given the new interpretation of visa overflow, almost all will be assigned to this category.

It is not yet clear whether Congress will actually try to pass any appropriations bills or whether they will merely pass a "continuing resolution" and leave the legislating until 2007. I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!
That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.

I was also told that there is new law which requires that the PERM fees should be paid by the employer (around 5-6k). Most desi consultancies used to ask the employees to pony up the labor fees. wonder how this will affect the conversion process.
It is ILLEGAL for the foreign applicant to pay for the PERM fees or the I-140 fees or lawyer expenses pertaining to either steps. The Employer MUST bear all expenses for this process. If you have evidence of wrongdoing, pls report it to DOL.
We should not be supportive of such violations of law - as a group it is not in our best interests.
The foreign applicant may pay all I-485 related expenses - or a generous employer can cover those expenses too.

Sc3 and other friends. Here is what has triggered this bad blood on the forum
Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal
July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal
Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.
I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything
The DOS algorithm to allocate unalloted Visas in the last quarter has so far been inconsistent. In previous years it favored EB3 and now it is totally skewed in favour of EB2 . From the deposition of the DOS @ congress they think that this year's algorithm will be the model for years to come.
Now , obviously that is great for EB2 because EB2 will get the lion share/complete share of the spillover . But death knell for EB3.
EB3 will not get anymore ~3000 visas every year till EB2 becomes current.
This will starve EB3 badly , EB2 will be current most of the time and EB3 will in 2001-02 time frame. There is a possibility that 2008 EB2 filers might GC ahead of 2003 EB3 filers.
Starving any particular queue badly does not help the throughput of any system .
I hope DOS will realise this and change their algorithm accordingly.
Each countries quota is equally divided among all EB categories, IMO, The spill overs also should be equally divided among all the EB categories.

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.
I had a similar experience in 2004 when I took Air France for the first time (to Delhi, connecting at Paris). It was the last time I ever took Air France.
