With predictions that the H1B cap will be reached any day now, employers and employees are rushing to beat the cap. United States Citizenship and Immigration Services (USCIS) announced that, as of December 4th, it had received approximately 61,100 H-1B petitions counting toward the congressionally-mandated 65,000 limit. Additionally, USCIS has approved sufficient H-1B petitions for foreign nationals with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petition filed on behalf of a foreign national with an advanced degree will now count toward the general H-1B cap of 65,000.
So why are they still accepting cases? Well not all filed H1B petitions will be approved so the final count will not be known until USCIS will clear all denials. We will keep you posted.

Hi
I received my 485 approval back in April 2008 & also received my physical card in next few months. I applied for my parents extension last month ( I-539) who are here for visit. It was filed in CA. My last H1B was approved in Oct 2007 from CA. Today to my surprise I see updates in extension case with no message change but update in my H1B approved case, with message saying that this case is reopened & the decision is being reviewed.
I think this is some kind of error. Has anyone experienced this ?

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill. One of my long-time paralegals at Siskind Susser, PC is Esther Schacther Fridman. Esther, who grew up here in Memphis, is the granddaughter of Holocaust survivors. In 2005, she married Benny Fridman, an Israeli who was on a work visa in Memphis at the time. A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

I want to know what options she has to stay in USA.
from last company her labor and 140 was approved .
Can she do visa transfer and start new labor ?
Its only 5-6 months left in her 6 year h1b visa .

I have future GC filed from Company X, the priority date is February 2006.
I am currently working for Company Y on H1B. This H1B will expire in April 2009. Company Y is also ready to file my GC and I would like to work with Company Y till by future GC is approved, my question is
If I have already filed for 485, EAD and AP through Company X, scenario will it be advisable to file another labour and I-140 through Company Y now?
What could be the implications?

Can anyone recommend a lawyer to handle a PERM/Green Card application for an attorney position in the DC area? My employer recently got a quote for 6-8k for legal fees and 10k for the recruitment ads.
Also 10k for Sunday print and other ads seems excessive and I am trying to show my employer that it can be done for less. Can anyone please share a sample add (preferably for an attorney) used for their PERM application?
