i m really in trouble plz help me by giving suggesstion to my question.
QUESTION:[/B]
[B]I came to US on March 28th 2008 on H4 Visa and applied on March 29th for new H1B with COS for Oct 2008 quota. I see the h1b approval of I129 petition on Jun 2, 2008 WITH attached I-94 WITH IT. Till today I have not received approval notice from my employer and did not applied for SSN and has not started working for my employer. On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN. Please verify if tht is correct.Also i dont have any paystubs uptil now.I need your help to understand my status right now in U.S and what is the right action to take now .
My H4 stamp in passport is till Oct 10th 2009 and my husband is right now working on H1B status.

The requirements depend on the International Student Office. They will give the best answer.
In my case, they required a letter from Deptt. I don't remember the contents of the letter.

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

I am on H1B 8th year extension, my priority date is September,2004. When I join new employer, Will I lose my current priority date as well as LC?
Depends on whether or not your I-140 is approved. If it is, and your old employer does not withdraw the petition then there is a possibility of carrying on with your old PD. I am no expert on this, but the issue has been discussed several times on this forum. Do a search for more info.

Iam on H1 and my wife and 2 kids are on H4. we have been here for 3.5 yrs now. My petition has to be extended next year. My employer is delaying my GC process (not applied yet).
My Wife's brother who is a citizen is planning to apply for I-130 for my wife (not sure if it can be applied for me and kids as well, that is a different question).
However my main questions are:
- if he applies for I-130 for my wife, will it affect her H4 status or will I-130 application be affected due to her H4 status here?
- Will we have a problem when we apply for the petition renewal next year?
- Also will it affect the employer based Green card application (whenever int he future my employer applies for me)?

What documents do they need to furnish ?
As I understand there are a lot of ppl who come to the US who do not have kids/relatives here, what do they have to show if they are just coming to the US for a Visit not work related ?
