While Congress has the ultimate responsibility to determine immigration law, the American Immigration Council reminds the President that he has substantial authority to make fixes to the immigration system within the confines of current immigration law. From AIC director Ben Johnson: Ben Johnson, Executive Director of the American Immigration Council, noted upon release of the memo: Ultimately, responsibility for failing to reform our dysfunctional immigration system rests on Congress. However, it is rarely the case that a Presidents hands are tied by existing lawand where the President disagrees with current law, his or her policy choices regarding the implementation of...

The fine folks at NAFSA have issued a report reminding people why the US needs to retain its commitment to international education and needs to fix many aspects of the current system. This sums up the importance of the subject: All prudent steps must be taken to prevent another act of mass terrorism on American soil. But a policy based in fear, that causes us to turn away from the world, is profoundly inimical to American securitybecause openness is part of security. The United States needs international students, professors, researchers, scientists, and future leaders coming to this country to further...

Hello All,
I just wanted to ask for your general advice. My H1B expires in July 2010 so I know I have to turn in my PERM application before then so I really have only about 2 months to start recruitment process. I also have a green card to Canada so I could go there but I do like my current job in the US and living in New York City is really great!
Anyway, my question is. How tough do you think it will be to start PERM process now in this current economic downturn and the fact that it is in New York (millions of people)? Do you also think there might be some legislation in a near future to make it more difficult for us to get green cards?
I understand you can't answer those questions exactly, but a piece of advice would be greatly appreciated. Thank you all!

Is the email printout of 140 approval enough to attach to 485 app.
I have not received the printed notice and do not want to wait for it.
I want to go ahead with attaching approved email of 140.
Is it ok ?
Thanks

My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too
Again, thank you

No, you only pay the visa application fees. India has a visa agreement with US so issuance fee is no longer required. You should check the US consulate website for more details.

I'm looking to travel to Puerto Rico for a few days in July for my honeymoon but both my green card and passport have both expired. I have been in the US since 1988 and don't travel aboard very often so I overlooked this issue.
I have been told that I can travel to Puerto Rico with just a valid driver's license but don't want to take a chance of having them ask me for my passport and green card and then not being allowed back in the country. I would think that if they ask me if I'm a resident alien, they woudl want to see a non expired green card. I assume it is too late to go through the renewal process for both with just a few weeks left before my trip. I would love to know if I need to go through the renewal process for my passport, green card or both in order to fly to Puerto Rico or if I should just stick to US states.
thanks!

All,
I wonder if more of you have noticed this phenomena: one of your applications gets approved, but the approval doesn't show up on the online case status system.
My AP was approved on Sept 17, 2007 and mailed out to my attorney who got it in a few days and told me about yesterday when I emailed about another issue. Oddly enough, even today (Sept 27), the online case status system shows an LUD of Sept 14 but no approval. I didn't get the usual approval email from the case status system either.
Annoying -- since now I won't learn of new developments till my lawyer calls me up to let me know and you know what slackers they can be. Although all this may be moot since apparently I am stuck waiting for my name check to clear, so there won't be any new developments to look look forward to for a long long time. Sigh. :(
Thanks,
Googler

I've heard from police before who believe that turning local law enforcement officers into immigration enforcement officers discourages people from reporting crimes and distracts the police from doing their jobs. They also know that illegally present immigrants are targets for criminals and this drives up the crime rate for everyone as crime is rarely contained in one community. The chiefs all called on Congress to pass immigration reform. This week, leading police officers from around the US held a press conference held a press conference in Washington that included Chief of Police Art Acevedo of Austin, TX Chief of Police...

From Metro Weekly: Following up on reports from this weekend, Metro Weekly just received confirmation from Christopher Bentley, the spokesman for the U.S. Citizenship and Immigration Services, that cases of foreign partners who are married to a same-sex partner and would otherwise be eligible for a green card are on hold in light of questions about the continued validity of the Defense of Marriage Act. Bentley writes, "USCIS has issued guidance to the field asking that related cases be held in abeyance while awaiting final guidance related to distinct legal issues." He notes, however, "USCIS has not implemented any change...

Guys,
Here how it goes, one of my friends visa date got current in June 2007. He applied for his I-140 and I-485. For some strange and unknown reason to me , he did not file I-485 for his wife who is on H4 and thought that he will file later once he gets his receipt. Now he has his receipt and was getting ready to file the i-485 for his wife it dawned on him that dates are retrogressed again and the lawyer told him that he cannot file I-485 for his wife. Now the situation is that he has to wait until the dates get current, but what if they dont and he gets his green and his wife dont which will automatically make his wife out of status and she has to go back and you all know how hard it is to sponsor on green card.
My question is that, is this the true statement that he cannot file I-485 for his wife due to retrogression since his wife is dependent and should be able to file since his dates were current?
If this statement is true what are the available options
Thanks
Rbashir
