Hi Seniors/Lawyer,
My brother is US Citizen and my parents visited US, my brother want to apply green card for my parents. What all the documents from India are needed from my parents to apply for GC?
1.What forms/applications do we have to apply?
2.What is the first step should we have to take?
3.Do we need to apply form I130 and along with that can we apply I485?
4.What all documents should my brother submit along with the forms/applications?
Please Seniors/Lawyers help me.

Only during I 140 USCIS will ask for Exp letter whatever you showed in PERM. I think your previous exp should be related to your new job role.

Dear Experts,
My wife's H1 is pending from H4. Its got selected in lottery and waiting for approval. But in the mean time we have to go to Canada and come back within 3 days. I would like to know if this impacts the COS. If it so, what are the options, means again can we apply for COS once we get the H1 approval without COS? Please let me know the options.

When preparing docs to provide response for 221g form, I have filled DS-156 form at http://https://evisaforms.state.gov/ds156.asp. On click of Continue, it generated a PDF with randon bar code. Printed that online. And sent to docs to VFS Hyderabad officer.
I was told that bar code is wrong, I should fill up another DS-156 form. Are they looking for DS-156 submitted at the time of interview that has HDFC receipt number as bar code.
Please let me know if you have faced this problem earlier.
They have retained my wife passport asked to produce to copy of current visa of husband. Can I reply to this online.

Sen. Elizabeth Dole, sadly, was not given points for sizzle -- or much else, for that matter. She ranked as the 95th most powerful senator. Yes, that is out of 100. Vying for the bottom rung was also Sen. George Voinovich, who despite serving since 1998 ranked 90th. And as if he hasn't already had a bad year (or two), Rep. seems to say that as long as you have a valid visa (which a greencard is a physical manifestation of an immigrant visa) then you should be ok.
Assuming your son is a US Citizen - he won't need one either.

I may be on the chopping block next week..
currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)
My 140 is pending...
so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
and in case if i get job ...can i get back on H1 and restart GC?
i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

Sorry for this new thread. But I need help in interpreting the information that I got when I went to Local Office.
My I485 is in Locak Office and it was transferred to the San Jose office after we had our interview in Boston back in October 2005.
When I spoke with the officer (not IO) he said that quote:
" Priority Date
AUA 1 or / 7/1/07
I 485 Forward to 245 Unit "
What does this mean? Can you guys help me understand what he is trying to say. I mentioned that we are already interviewed.

Here is a possible scenario I might run into next year after I change employers this month and restart my GC process.
Assuming the following:
1) I have approved I-140 with new employer by Sep 2012 and I am able to port my old PD
2) My PD is Nov1 2007 under EB2. PD becomes current in Sept 2012 and I apply for I-485
3) My employment contract gets over in Nov 2012 and I have to change jobs
What happens then.
1) Will I need to change jobs based on approved I-140 ?
2) Will I be able to keep the I-485 application going ?
3) If the I-485 adjudication occurs while I am at new job and it hasn't been 180 since I filed for I485 what happens ?
4) What happens if PD retrogress in October 2012 ?
Assuming the following:

Folks, I'm in the current sitation. In 6th year of H1B, aplied for PERM labor pending with ATL processing center for >15 mtonhs. Attorneys are filing for 7th year extension. I need to traval in the next 2 weeks but not confident enough to get everything right, I need my visa stamped aswell, which with the current H1B validity, would be onlyuntil 22nd Oct 2009. I did try to convince my Managers that they file the extension under premium processing and I could get extended visa until Oct 2010, but Attorney advised that it is not necessary and I should be fine to go, get my visa stamped and come back.
2 points I'm concerned about are,
1. Since I have < 6 months validty on current H1B is it safe to travel and I would hopefully have my extsntion reciept number when I go for stamping.
2. Heard lot about denial of entry at POE, I'm trying to avoid certain airports that I has problems (JFK, EWR etc). Not sure I'm doing enough to be safe.
Any advise is greatly appreciated.
