My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

Hi All,
USCIS has mailed my wife two different EADs upon renewal. The first EAD sent to us has a 2yr validity. About a couple of weeks later, she got another one, this time with a 1yr validity.
I spoke with my attorneys and they seem to indicate that the one with the 2yr validity should be the valid document of reference from here on.
My questions are,
1) have any of you experienced this kind of a goof up before?
2) do I just take my lawyer's word for it and ignore one of them?
Please advise...

According to this post on Murthy.com at http://www.murthy.com/nflash/nf_043007.html , it looks like the LC substitution will soon be a thing of the past. How do you assess the impact of this on EB retrogression?

Hi,
When u use EAD and AP to come back into US, then u loose your H1 status.
About reverting back to H1 from EAD, there are many Ifs and buts. You should have a valid H1 maintained etc. Consult a good attorney.

I am going to complete 6 years on H1-B by 2009 March. When we applied for the H1-B Transfter to my current company last year for some reason I got the extension upto Jan 2010 which is more 6 yrs.
I was on L1 until 2004 Jan for 9 months in the begining and my previous company converted L1 to H1 in Jan 2004.
My question is do I need apply H1-B extension on approved I-140 to get 3 more years extension as 2010 Jan will be my 7th year on H1-B ? OR I can wait upto current transfered H1 - B approval validity?
Please advise.

I think he lieing. As long as you change the employer, you can file in the same EB category.

Hi,
In the process of renewing EAD, I realized that I got 2 EAD cards. One is through my own i-485. The second one was piggy-back from my spouse's i-485. To renew it, should I renew both?
The reason of two i-485 is a long story. Mine is EB-2, thus shorter retrogression. But back then, my job was shaky. At a matter of fact, I left the company before 180 days after i-485. I got I-140 later from the employer though.
So i applied another i-485 with my spouse's EB-3 i-485, thus another EAD.
I don't want to abandon my I-485 or my spouse's I-485. Should I apply to renew both EADs?

HI,
I have concurrent filed I140 and 485 in Aug 2007. My I 140 is still pending. Can some one let me know what could be the reason. Is there any one whose i140 is pending since last three years.I am worried because processing time is around 4-6 months.Any help in this regard will be appriciated.

All you have to do is...while in the preview and export editor click Fill Options in the output options box and then pick Mesh Gradiant shading from the fill style dropdown menu. That should solve the problem because it is probably rendering with cartoon average fill as default.

1. I last entered US in Dec 2009 on H1B valid till Sep 2012.
2. Was laid off, changed my status to F1.
3. Got new employer, transferred my H1B to the new employer, got approval notice with no I 94 attached. My H1B visa stamping is valid till Sep 2012.
What are my options? Do I need new H1B visa stamping? Or just re enter with new I94?

Tried to post in another, old thread - no response for several days, so decided to create a new one.
I asked my employer to create sub-account for me at http://www.plc.doleta.gov so I could check my PERM case status without polling them. The employer got back to me and said "looked into the site and I couldn�t find the way to create user account to view your case only".
They dont mind making sub-account for me, same way they do for attorneys and paralegals, but they dont want me to see their other pending cases or any information, unrelated to my case. So, my question is: is there a way to create sub-account, which would allow seeing my own case only?

Hello,
I am currently working for employer A on a 6th year H1 with approved 140 petition. MY current H1 is expiring June 2010. In the meantime I got an good offer from employer B who applied for H1 transfer using my approved 140 petition and I got an RFE. My question is god forbid , that if my H1 transfer petition is denied with employer B , can I continue working for Current employer A and if he can file for my H1 extension, come June? Also would there be any recursions, considering i already applied the H1 transfer now with the new employer ?
Please advice and i thank you in advance

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

TSC 485 processing date says Aug 17,2007.
Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
